01 Agreement to terms

In short: Using our Services means you accept these Terms in full.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date at the top of this page, and you waive any right to receive specific notice of each such change. It is your responsibility to review these Terms periodically to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Services after the date such revised Terms are posted.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to place orders through the Services without the involvement of a parent or guardian.

02 Our services

In short: Krishna Dairy sells fresh dairy, cold-pressed oils, sweets, and grocery essentials, delivered locally in Kota.

Krishna Dairy is Kota's dairy and grocery store, offering daily dairy essentials such as fresh cow milk, paneer, curd, and pure cow ghee; freshly extracted cold-press and edible oils including mustard, groundnut, coconut, and sesame; sweets and confectionery; freshly ground flours and namkeen; and select in-store specials such as fresh ice cream, khoya, and hot jalebi. We operate from our outlet at Shop No. 2, 89-A/R, R.K. Puram, Kota, Rajasthan - 324005, and offer local delivery, including expedited delivery options, subject to availability in your area.

We reserve the right to change, suspend, or discontinue any product, pricing, or delivery option at any time without prior notice.

03 Orders, pricing & payment

In short: Prices are shown at the time of ordering and may change; we may decline or cancel any order.

• All prices are listed at the time you place your order and are subject to change without notice. We are not liable to you or any third party for any price changes made after an order is placed but before it is confirmed.
• We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity. If your order is cancelled after payment has been taken, we will issue a refund for the affected items.
• You agree to provide current, complete, and accurate purchase and contact information for all orders. You further agree to promptly update your account and other information so that we can complete your transactions and contact you as needed.
• Payment must be made through the methods we make available at checkout or on delivery. You represent that you are authorized to use the payment method provided.

04 Delivery

In short: We deliver within Kota and nearby areas, with delivery windows given as estimates.

We aim to deliver orders promptly, including expedited delivery for eligible orders and standard local delivery for others. Delivery times are estimates only and are not guaranteed; they may be affected by factors outside our control, including weather, traffic, and order volume. Please ensure someone is available to receive perishable goods at the delivery address and time provided, as we are not responsible for spoilage caused by delayed collection after a successful delivery attempt.

Delivery is currently limited to Kota and surrounding areas we designate as serviceable. We may decline to deliver to addresses outside our service area.

05 Returns, refunds & cancellations

In short: Because most items are perishable, returns are limited to quality issues reported promptly.

Given the perishable nature of dairy products, fresh oils, sweets, and prepared foods, we are generally unable to accept returns once an order has been delivered. If you receive an item that is damaged, spoiled, incorrect, or otherwise does not meet our quality standards, please contact us as soon as possible, and in any case within 24 hours of delivery, along with a description or photo of the issue. We will review each report and, where appropriate, offer a replacement or a refund at our discretion.

Orders may be cancelled before dispatch by contacting us directly. Once an order has been prepared or dispatched for delivery, it can no longer be cancelled.

06 Prohibited activities

In short: You may use the Services only for their intended, lawful purpose.

You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create a collection, compilation, database, or directory without our written permission.
• Trick, defraud, or mislead us or other users, especially in connection with orders, payments, or attempts to obtain sensitive account information.
• Circumvent, disable, or otherwise interfere with security-related features of the Services.
• Use the Services in a manner inconsistent with any applicable laws or regulations.
• Upload or transmit viruses, Trojan horses, or other harmful material.
• Use the Services to compete with us or for any commercial purpose we have not authorized.

07 Intellectual property rights

In short: The content on our Services belongs to us or our licensors and is protected by law.

Unless otherwise indicated, the Services, including all source code, databases, functionality, software, website designs, text, photographs, and graphics on the Services (collectively, the "Content"), and the trademarks, service marks, and logos contained therein (the "Marks"), are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and Marks are provided on the Services "as is" for your information and personal, non-commercial use only. No part of the Services may be copied, reproduced, distributed, or exploited for any commercial purpose without our express prior written permission.

The Services may contain links to other websites or content belonging to or originating from third parties. Such external links are not investigated, monitored, or checked for accuracy or completeness by us, and we are not responsible for any content of any linked website. Inclusion of a link does not imply endorsement by us of the linked site.

09 Disclaimer of warranties

The Services are provided on an "as-is" and "as-available" basis. You agree that your use of the Services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services and your use of them, including implied warranties of merchantability and fitness for a particular purpose. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

10 Limitation of liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Services will not exceed the amount you paid us for the order giving rise to the claim.

Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages; in such jurisdictions, some or all of the above limitations may not apply to you, and you may have additional rights.

11 Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Services, your breach of these Terms, or your violation of any rights of a third party.

These Terms remain in effect while you use the Services. We reserve the right to deny access to and use of the Services, without notice or liability, to any person for any reason, including breach of any representation, warranty, or covenant contained in these Terms, or of any applicable law or regulation.

13 Governing law & disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Kota, Rajasthan.
